If the land was owned by the deceased, then the male inherits a share equal to that of two females, whether the land is agricultural or non-agricultural, based on the Almighty’s saying: "Allah instructs you concerning your children: for the male, what is equal to the share of two females." It is not permissible for the guardian (Wali al-Amr) or anyone else to alter these legally prescribed shares. Obedience to the guardian is conditional upon not disobeying Allah; there is no obedience to a creature in disobedience to the Creator. The right of inheritance does not lapse by prescription (statute of limitations), even though the validity of the claim and the judge's hearing of it may vary with time and circumstances, but the right itself remains constant.
