A husband's statement to his wife, "You are divorced," is an explicit divorce (talaq sareeh) by which the divorce takes effect. The fact that it occurred during a period of purity (tuhr) that was preceded by intercourse makes it an innovative divorce (talaq bid'i), but it is nonetheless valid despite its unlawfulness. The issuance of divorce in a state of anger does not prevent its occurrence unless the anger causes a loss of awareness. It is advisable to present the matter to the Sharia court or to trusted scholars. The husband should also be reminded of the impermissibility of severely beating his wife.
