Is it permissible for a husband to divorce his wife, whom he did not desire since the engagement due to defects he dislikes, knowing that he was subjected to sorcery which caused him to be unable to tolerate her, and that his family forced him to marry her, and he still does not desire her after the effect of the sorcery has worn off, and he does not want to have children with her while she wants him and does not want a divorce? And would he be sinful by divorcing her?
Divorce without need is disliked (makrooh), and some scholars have even deemed it forbidden (haram). If you wish to divorce your wife because you are harmed by her shortcomings, there is no sin upon you. However, it is preferable that you be patient with her as long as her treatment is good. The reason for your aversion to her might be magic (sihr), but it is not permissible to accuse anyone of it without clear evidence. The cure for magic is easy through regular recitation of remembrances (adhkar) and ruqyah (spiritual incantations). The presence of affection and harmony requires patience and overlooking (faults), as well as focusing on the good aspects. Allah Almighty says: (And live with them in kindness. For if you dislike them - perhaps you dislike a thing and Allah makes therein much good), and the Prophet, peace and blessings be upon him, said: "No believing man should hate a believing woman. If he dislikes one of her characteristics, he will be pleased with another." Procreation is a mutual right of both spouses.
