What is the ruling on a mother, irrevocably divorced three times, remaining in the marital home and serving her husband, and what is the optimal course of action to deal with this situation, including the fate of the shared apartment, especially given the uncertainty of both parties and some of their children regarding the number of divorces?

The fundamental principle concerning divorce is that it is in the husband's hand and is confirmed by its number. However, if the husband retracts and denies it, it is advisable to consult the competent authorities for personal status cases to resolve the matter, either by confirming the husband's statement and the continuation of the marriage or by ruling on a definitive separation (baynunah).

If the competent authority rules for a definitive separation, it is not permissible for the wife to reside with her ex-husband in the same house unless each of them has independent facilities; because she has become a stranger to him. Therefore, it is not permissible for her to remove her hijab in front of him or to allow him to be alone with her.

If the parents are found in a situation that warrants disapproval, it is obligatory to disapprove gently and without violence, while always seeking to honor them.

As for selling the apartment, the matter rests with the parents, as they are its owners, and they will consider what is best for them.
