What is the ruling regarding a husband and his wife, whom her husband divorced verbally several times by saying, "You are divorced," and "You are thrice-divorced," and "You are forbidden to me and divorced from me," without official documentation, and he has forsaken her for five years, while she lives in the same house with her children?
If a husband has divorced his wife with three pronouncements of divorce, she is irrevocably separated from him by a major separation, and she is not permissible for him until she marries another husband. It is permissible for a divorced woman who has been irrevocably separated to remain in her ex-husband's home for the upbringing of their children, provided that there is no private seclusion between them and that she lives an independent life. The maintenance of the children is obligatory upon the father by scholarly consensus, and it includes housing, food, drink, clothing, education, and medicine. It is to be estimated according to what is customary and takes into account the father's financial situation. And the divorced woman who breastfeeds one of her children has the right to demand payment for breastfeeding.
