Is it permissible for a woman to seek a divorce (khulʿ) from her husband due to his old age? Is a man who does not provide for his wife or give her her rights considered disobedient (nashiz)? And should a woman give up part of her right in exchange for this disobedience?

Islam aims to preserve the family and its stability, and its rulings are issued with justice and wisdom, which necessitates submission to them.

If the husband fears his wife's aversion to him, or the wife fears her husband's aversion to her, they may reconcile by waiving some rights.

If the wife dislikes her husband due to his old age or unattractive appearance, and fears that she will not be able to observe God's limits with him, she may seek a Khula (divorce initiated by the wife) in exchange for compensation to free herself.

A man's nushuz (disobedience/rebellion) is his arrogance towards his wife and his aversion to her, and a woman's nushuz is her disobedience to her husband and her haughtiness towards him.

The Sharia has granted the wife the right to discipline the husband, but it has not granted the husband the right to discipline the wife, in order to preserve family stability. The aggrieved wife has the right to refer her case to the Sharia judge.
