Must I make up for the Ramadan fasts of the years 1432 and 1433 AH, given that fasting this year was better for my health condition, and that my health condition is still deteriorating?
There are three opinions among scholars regarding this:
1. Only expiation (fidyah) is required, not making up the fast (qada’): This is the relied-upon position of the Shafi'i school. Making up the fast is not required, even if one later becomes able to fast. 2. Making up the fast (qada’) is required: This is the position of the Hanafi school and one view within the Shafi'i school. 3. Detailed view: If one recovers after paying the expiation, there is no need to make up the fast. However, if one becomes able to fast but has not yet paid the expiation, then fasting becomes obligatory. This is the position of the Hanbali school.
The most apparent view is the first one, where expiation suffices for the fasts missed due to the excuse, whether it was paid or not. Making up the fast is not required, because difficulty necessitates ease (a legal maxim). Therefore, you are not required to make up the fasts you missed due to chronic kidney disease.
