Whoever has intercourse with his wife during the daytime in Ramadan must offer sincere repentance and an expiation (kaffarah). The expiation is in sequence: freeing a slave, and if unable, then fasting for two consecutive months, and if unable, then feeding sixty poor persons. He must also make up for the day that he spoiled by intercourse.

As for the wife, if she was forced, there is nothing upon her. If she was willing, she must certainly make up the day. There are two opinions regarding the obligation of expiation upon her, and the preponderant opinion is that it is not obligatory for her.

Both spouses must strive in sincere repentance and righteous deeds.
