Is it permissible for a wife to seek divorce from her husband who insults and beats her, forces her to stay overnight at his family's home, refuses to let her communicate with her own family, is stingy with his money and affections, and wants to take all her property and mahr in exchange for divorcing her, knowing that she does not want to have children with him and fears filing a case against him even though everything is registered in her name?

Mistreating one's spouse indicates weakness of faith and poor upbringing. It is impermissible for him, according to Sharia, to resort to beating and humiliation. The wife should not accede to the husband's demand for khul' in exchange for the mahr. The wife has the right to claim her registered rights and resort to the judiciary. It is advisable to try and counsel the husband before resorting to legal action, as he may realize his mistake. It is also recommended to improve one's connection with Allah and maintain acts of obedience, for tribulation may be a means of returning to Him.
