A woman is permitted to seek divorce for harm from a husband who neglects his prayers, drinks alcohol, and is deficient in providing for her. She may refer her case to the court to compel him to fulfill her rights and the rights of her two daughters, or she may seek khul' from him by returning his dower. If she chooses to remain with him, she must obey him and go to his home unless he permits her to stay with her family; otherwise, she is disobedient (nashiz) and has no right to maintenance. It is advisable to perform Istikhara (prayer for guidance) and consult those with sound judgment regarding separating from him or remaining with him, bearing in mind that the harm of staying with someone who abandons prayer and drinks alcohol is greater than the harm of separation.
