Habitual drinking is a major sin and a great transgression, indicating a thinness and weakness of faith. As for one who abandons prayer while acknowledging its obligation, his status is that of a transgressor (fasiq); indeed, the Sharia evidences indicate his disbelief. Associating with a transgressor and living with him is a clear harm, for the Messenger of Allah, peace and blessings be upon him, said: "There should be no harm nor reciprocating harm." For whoever is afflicted with such a situation, she should seek a divorce from him, even if it requires compensation. If he refuses, she should refer her case to the Sharia courts.
