However, if he acknowledges their obligation but neglects them due to laziness, or stinginess, or shyness, he does not become an apostate by that. He should be advised and urged to repent. If he does not repent, then you should seek a divorce or raise your matter to an Islamic center. The custody of the daughter is your right as long as you do not remarry. Before seeking a divorce, weigh the harms of divorce against its benefits.
