It is permissible for the wife's brother to dispose of the store's merchandise if the owner of the store gives him permission. Otherwise, he is an encroacher and guarantor. The sales transaction between the wife and her brother is Islamically invalid because the price is deferred for an unknown term. However, the Hanbalis hold that the contract is valid and the condition is void. The debt resulting from this transaction is considered the wife's responsibility, and the husband is not obligated to pay it unless he voluntarily does so out of kindness. It is permissible for the husband to pay his wife from his to settle her debt.
