Does a triple divorce occur if a man stipulates to his wife that she not leave the house, and she does leave, and is it permissible to take her back verbally without her knowledge, with two witnesses, to give her time to think?

The majority of scholars hold that a divorce conditional on a certain event takes effect upon the fulfillment of that condition, and that uttering the triple divorce pronouncement counts as three divorces. Our fatwa (definition) is that the wife becomes irrevocably divorced (baynunah kubra), and her husband has no way back to her unless she marries another man willingly, he consummates the marriage, and then divorates her or dies, and her waiting period (iddah (definition)) expires. The divorce is effective even if it is not documented in the courts, and reconciliation (raj'ah) is valid without written documentation or witnesses.
