Is it permissible to seek divorce from a husband who prevents his wife from visiting her family, forces her to visit his mother who insulted her, deserts her and quarrels with her after he visits his mother, and has sworn to divorce her if she visits her family?

A husband should not prevent his wife from visiting her family unless he fears a harm, and he should be a helper to her in maintaining ties of kinship. A husband hitting his wife aggressively and oppressively contradicts Allah's command for good treatment. The Sharia (definition) permits hitting within narrow limits, though it is better to avoid it. Good treatment between in-laws is required, and insulting or exposing the mother-in-law is a reprehensible act. A father or brother hitting the husband without just cause is also a reprehensible act. Counseling and understanding between the spouses are necessary, as well as striving for reconciliation and seeking the intervention of good people. Swearing by divorce has the ruling of a conditional divorce: if one breaks the oath, divorce occurs according to the majority of scholars. Ibn Taymiyyah, however, held that an expiation for an oath is due if divorce was not intended.
