What is the ruling on a wife remaining with a husband who is unjust in providing lodging and financial support, mistreats and insults her, curses her family, does not provide her with stable housing, and frightens her with divorce; and does she have the right to seek divorce for harm despite the husband's insistence on taking her back?

It is obligatory for the husband to spend on his wife in a reasonable manner and to treat her kindly. He must also be just among his wives in division of time if he is married to more than one, and it is not permissible for him to stay with one of them more than the others unless she consents. If the husband is unjust to his wife by this action, and disobedient to his mother, then the wife has the right to seek divorce (Talaq (definition)) or annulment (Khul'). It is advised to consult with wise individuals and weigh the harm of divorce against the harm of staying, choosing the lesser of the two harms, while seeking Allah's help and supplication.
