A child is attributed to a man if the child's mother is a woman of the Book, and the man contracted marriage with her, believing the contract to be valid, and consummated the marriage based on it, even if the contract was, in reality, invalid. However, if the mother is not a woman of the Book, or if she is a woman of the Book but no contract was made with her, or if an invalid contract was made with her and the husband did not believe it to be valid, then the child is considered a child of fornication and is not attributed to him. A child who is not attributed to his father's lineage should not be cast away or humiliated; rather, he should be treated like any other Muslim, and his maintenance and care become an obligation upon the Muslims. The second contract, made after the woman's conversion to Islam, is valid if it fulfills the conditions of marriage, whether it occurs before or after childbirth. The marriage contract for a Muslim woman must be handled by her Muslim guardian, or by the ruler, or by the Muslim community.
