If their negligence is proven, then the full blood money becomes obligatory upon them, or a proportion thereof corresponding to the extent of their responsibility. However, medical costs, funeral expenses, and burial costs are not obligatory upon the driver, because Islamic law has only mandated blood money. If there are no Sharia courts, it is permissible to resort to other courts, provided that no more than the legitimate Islamic right to blood money is taken. It is permissible to accept what the insurance company pays, even if it is labeled as medical costs or funeral expenses, provided that the total amount paid does not exceed the legitimate Islamic right to blood money."
