Is eating the mynah bird permissible, knowing that it is a brown bird with a yellow beak and a yellow patch around its eyes?

The mynah bird is permissible to eat, for the default ruling is that all birds are lawful, as Allah the Almighty says: (Say, "I find not within that which was revealed to me [anything] forbidden to one who eats it, except that it be a dead animal or blood spilled forth or the flesh of swine — for indeed, it is unclean — or what is immorally offered, on which the name of other than Allah has been invoked." But whoever is forced [by necessity], neither desiring [it] nor transgressing [its limit], then indeed, your Lord is Forgiving and Merciful).

Exceptions are those for which there is evidence of their prohibition, and these are four types: 1. Those with talons used for hunting, based on the hadith of Ibn Abbas (may Allah be pleased with them both): "The Messenger of Allah (peace be upon him) forbade [eating] every predatory animal with fangs and every bird with talons." 2. Those that eat carrion, such as the vulture, the Egyptian vulture, and the pied crow. 3. Those considered repulsive, such as the bat. 4. Those that are forbidden to kill, such as the hoopoe, based on the hadith of Ibn Abbas (may Allah be pleased with them both): "The Prophet (peace be upon him) forbade killing four animals: the ant, the bee, the hoopoe, and the shrike."

The mynah bird does not fall under these prohibitions. Its designation as a "crow" does not affect the ruling, as many jurists permitted the rook (a type of crow) because it does not eat carrion.

The criterion for what is permissible among birds is that which "does not hunt with its talons, does not eat carrion, and is not considered repulsive."
