A woman is permitted to seek khulʿ (divorce at the wife's instance, usually by returning the dower) if she dislikes her husband due to his character, appearance, religious commitment, old age, or weakness, and fears that she will not be able to fulfill God’s rights concerning obedience to him. It is commendable for the husband to grant the request for khulʿ. It is permissible for a man to take back more than he gave her, but it is disliked for him to do so, based on the Prophet’s (peace be upon him) statement in the hadith of Jamilah: “And do not take more.” The consideration is what they both agree upon.
