The question

What is the ruling of Islamic law on a man who refuses to give his divorced wife her rights of an irrevocable divorce, and stipulates that she must file a divorce lawsuit to absolve him of the financial support (nafaqah), knowing that he is well-off, treats his seven children poorly, and wants to evict her from the house, and she has no shelter?

The answer

A woman divorced with a final and irrevocable divorce (talaq bain) is not permitted to live with her former husband in the same house, as she is a stranger to him, and this would lead to forbidden acts. However, she may reside in a separate room with her own facilities if the ex-husband's house is large enough. As for housing expenses, these are obligatory upon the father for his children and may also be for the custodian. It is not permissible to harm the wife to coerce her into ransoming herself. If your husband divorced you with a final and irrevocable divorce and withheld your rights and the rights of your children, you may refer the matter to the Sharia courts to claim your right and the rights of your children, and to present evidence of the divorce.
