What is the ruling on a wife remaining with her husband whom she dislikes due to his shortcomings in fulfilling her rights, and whom she psychologically rejects, while he refuses to divorce her and she does not possess money for khulʿ?

If the wife is able to be patient with her husband and tries to reform him through good counsel, that is preferable. If these means are not successful, she may inform her guardian to compel him to fulfill his marital obligations, or she may refer her case to the Sharia court. If his destitution and refusal to provide maintenance are proven, she may request annulment. However, if the husband is fulfilling his rights but she dislikes him due to his character, she may request a khul' (divorce at the wife's instance), and it is sunnah for the husband to grant her request. A khul' is not valid except with the husband's consent, and he is paid the agreed-upon compensation, after which he divorces her, as occurred with the wife of Thabit ibn Qays.
