A woman is not permitted to seek a divorce except for a valid reason, such as hardship or difficulty. There are indeed defects in one spouse that grant the other party the right to annul the marriage (فسخ النكاح). These are any defects that cause the other spouse to recoil and prevent the realization of the marriage's purpose, which is mercy and affection. These defects include those that existed before the marriage or occurred after it. The husband's illness, if it disrupts the purposes of the marriage, may permit the wife to seek annulment or divorce. However, patiently enduring her husband's illness is better for both her and him. If she is unable to do so, then there is no blame upon her for seeking a divorce.
