As for a matter that has already been presented to a court and ruled upon, there is no need to seek a fatwa regarding it, because the court has the final say in this type of case. Regarding a father's failure to financially support his minor children despite his ability to do so, this is a dereliction on his part of what Allah has obligated him to do. The mother has the right to present her case to the judiciary to demand maintenance, which includes suitable housing for them. If he sells their dwelling, he is obligated to provide another dwelling for them, whether it be owned by him or rented.
