What is the ruling on the Hajj of one who intended not to hasten and to stay the night of the thirteenth, then returned due to the death of his mother before casting the pebbles on the third day and performing the Farewell Tawaf? And what is required of him if he had delayed the Tawaf of Ifadah until the last day along with the Farewell Tawaf and did not perform it?

You must spend the night and stone the Jamarat (definition) on the thirteenth day. If you did not stone, you owe a dam (sacrificial offering). You also owe another dam for not performing the Farewell Tawaf (definition), based on the saying of Ibn Abbas, may Allah be pleased with them both: "Whoever forgets or omits anything from his rituals, let him shed blood (offer a dam)." You do not owe a dam for not spending the rest of the night in Mina because it is not obligatory. As for Tawaf al-Ifadah, it is a pillar that cannot be compensated for by a dam, and the Hajj is not valid without it. Therefore, you must return to Mecca to perform Tawaf al-Ifadah, and women are not permissible for you until you perform it.
