The majority of scholars do not obligate the congregant to recite Al-Fatihah. The Malikis and Hanbalis hold that it is not obligatory, whether the prayer is audible or silent. The Hanafis believe that the congregant should not recite at all. As for the Shafi'is, they obligate the congregant to recite Al-Fatihah in all circumstances, and this is the relied-upon opinion for fatwa. It is preferable for the congregant to recite Al-Fatihah after the Imam recites it, or during the Imam's pauses.
