If the lost item (Luqata) is trivial, it is permissible to own it immediately. However, if it has value, it must be publicized for a year, and then the finder may do with it as he wishes. This is based on the Prophet's (peace be upon him) saying: "Recognize its tie and its strap, then publicize it for a year. If it is not recognized, then spend it, and let it be a trust with you. If its owner comes seeking it one day, then give it to him." If the finder gives it away as charity, then when its owner comes, he is given the choice between affirming the charity or claiming restitution for its equivalent. There is no difference in this matter between European and Islamic countries.
