A wife's departure from her husband's home without his permission is considered a prohibited act of disobedience (nushooz) that nullifies her right to maintenance. Scholars have adduced as proof for this the saying of the Prophet, peace and blessings be upon him: "If your women ask your permission to go to the mosque at night, permit them." The husband is advised to strive to resolve the issue by reminding his wife of Allah and of his rights over her. If she does not respond, there is no impediment to marrying another.
