The jurists differed on the ruling of performing Sa'y before . The majority held that it is not valid because it contradicts the action of the Prophet (peace be upon him). On the other hand, 'Ata, Dawud, and a group of scholars maintained its validity, citing the hadith "There is no harm." The more authoritative opinion is the first one. Whoever performed Sa'y before Tawaf must return to Mecca to perform it. If unable, they must sacrifice a sheep for complete release from the state of for Hajj. There is no penalty upon them if they had conjugal relations after the Sa'y due to ignorance.
