The fatwa adopted by us is that divorce during menstruation, or during a period of purity in which intercourse occurred, is valid despite its being an innovation (bid'i). The divorce of an angry person is also valid, even if his anger is intense, as long as he has not completely lost his mind. However, some scholars, such as Ibn Taymiyyah, are of the opinion that an innovative divorce (talaq bid'i) is not effective, nor is the divorce of an angry person if his anger is intense. There is no harm in acting upon the saying of some scholars in matters of differing opinions, as long as the questioner is confident in the soundness of the opinion and is not merely following his desires.
