If a husband divorces his wife with three pronouncements of divorce, she becomes irrevocably separated from him, and she is not lawful for him again unless she marries another man willingly, and he consummates the marriage with her, and then he separates from her or dies, and her 'iddah (definition) (waiting period) expires. The divorce takes effect even if it was pronounced in a state of anger, as long as he did not lose consciousness. As for conditional divorce, it takes effect upon the fulfillment of the condition according to the majority of scholars. However, others hold that if the intention behind it was threat or emphasis, it does not take effect, and an expiation for a broken oath (kaffarat yamin (definition)) becomes due. The matter should be presented to scholars to assess the husband's state at the time of uttering the divorce.
