What is the ruling on one who habitually eats suhoor—sometimes intentionally—until after the adhan of Fajr begins, relying on the opinion of some scholars who permit drinking during the adhan due to a difference between the time of the adhan and the actual time of Fajr, even though he knows what is more cautious? And is the action of one who takes the more cautious approach considered an act of extremism?
A fasting person must stop eating and drinking as soon as dawn breaks. It is not permissible to drink during the Fajr adhan if the muezzin is calling it at the correct time. However, if he is calling it before the time enters, there is no harm in drinking until one is certain that the time has entered. And whoever relies on the existence of a difference between the adhan time in the calendar and the true time of Fajr, there is no harm upon him, although it is safer to avoid areas of disagreement. Stopping before dawn breaks is not an act of extremism, for the Prophet, peace and blessings be upon him, and his companions, had their pre-dawn meal (suhoor) before the prayer for a duration equivalent to reading fifty verses.
