Is it permissible for the first Imam to expel the second Imam from the house designated for him within the mosque garden? Is the designation by the local community of who the second Imam should be considered a condition set by the endower (waqif)? Is one who expels him sinful? And should whoever resides there afterwards be informed of the endower's condition, and are they sinful if they do not adhere to it?

The first Imam must refer to the Awqaf (Endowments) Administration for the appointment of a new Imam for the mosque, as it is the competent authority for this matter. However, if there is a condition from the endower that the appointment of the Imam is entrusted to the Imam of the mosque, then in this case, he may appoint an Imam, provided that the people of the neighborhood approve of him. If the new Imam is appointed and is qualified for imamate, it is not permissible to dismiss him except for a legitimate reason, such as his impiety or negligence. As for the mosque garden, if it is an endowment, it is not permissible to build upon it unless the supervisor (nazir) or the people of the mosque see a benefit in doing so.
