What is the ruling regarding a husband divorcing his wife by saying, "You are divorced, divorced, divorced," followed by his statement, "I will never take you back," and then his saying that this is the first divorce and he will send the second and third through the court, especially given that the wife has no desire to return to him?

If a husband says to his wife, "You are divorced, divorced, divorced," then if by the second and third utterances he intended to initiate new divorces, she becomes irrevocably divorced from him with a major separation (baynunah kubra), and he cannot take her back. However, if he intended by them to merely emphasize, then only one divorce occurs, and he can take her back. Some scholars, like Ibn Taymiyyah, held the view that a triple divorce pronounced in one sitting counts as a single divorce, regardless of whether emphasis or initiation was intended. According to this view, he can take her back as long as the 'iddah (definition) (waiting period) has not ended. It is recommended to consult religious courts in such cases.
