What about the difference of opinion among scholars and adopting the more cautious view?

The sources of Islamic legislation are the Qur’an and the Sunnah (definition), and scholars derive rulings from them. Their consensus is a proof, and their disagreements arise from their differing understandings of the text or, if it is a Hadith (definition), from doubts about its authenticity. A Muslim should adopt the more cautious opinion when there is a disagreement, unless there is a necessity. Not every disagreement is valid unless it has an acceptable basis according to scholars.
