Is my choice of a gold set considered an agreement on the deferred dower, and what is the Shar'i ruling on not giving it to me? Is my divorce Islamically void, being a coerced divorce? How does a just judge assess the "mut'ah" (compensatory gift)? What is the meaning of "the العصمة (bond of marriage) being in the man's hand"? And how can I establish proof against my ex-husband's family for practicing magic against me?
The world is a house of trials, and the believer must exercise patience and seek recompense from Allah for His decrees, for some trials may contain good within them.
As for matters of dispute, it is preferable to present them to the Sharia court: 1. The Mahr (Dowry): If it is known and acknowledged by the husband or proven by evidence, it is binding on the husband. If it is not known, but its type is known and the husband acknowledges it, it is binding on him. Otherwise, the wife is entitled to an average mahr. If the husband denies the amount of the mahr and the woman has no evidence, the woman's word is accepted if she claims a mahr similar to hers or less, whether before or after consummation. The Malikis hold that the spouses swear an oath and the marriage is annulled before consummation, but after consummation, the husband's word is accepted if it is customary to expedite the mahr. 2. Divorce: It is valid even if it was at the insistence of the family, unless coercion is proven, and it is not binding on him if it was a result of magic that is difficult to prove. 3. Mut'ah (Consolatory Gift): There is no minimum limit for it, and it is given according to the divorcer's financial ease or hardship. 4. Maintenance: The wife has the right to claim past maintenance, which is a debt owed by the husband that does not lapse.
The wisdom behind making divorce in the hands of the man is that he is the one in charge (Qawwam), more keen on the continuity of the marriage, and more patient with problems than the woman.
