What is the ruling regarding the Hajj of a wife who menstruated on the Day of Arafah, then performed Tawaf Al-Ifadah while she was menstruating due to a compelling necessity, and then after her return to her city, intercourse occurred, bearing in mind that she did not perform Tawaf Al-Ifadah while pure?
According to the majority of scholars, a menstruating woman's circumambulation (tawaf) is not valid. Your wife remains in a state of ihram and must return to Makkah to complete her rituals. This is the most cautious opinion.
There is a second opinion that considers the tawaf of a menstruating woman to be valid, but she must offer a badana (camel or cow) for performing tawaf while menstruating. This is the madhhab of Abu Hanifa and one narration from Ahmad.
A third opinion holds that it is permissible for a menstruating woman to perform tawaf out of necessity, and there is no penalty on her. This is the choice of Ibn Taymiyyah.
If you have followed one of the trustworthy scholars in this matter, we hope that this will be sufficient and your wife will not be required to return to Makkah.
However, it is advisable to go to Makkah to complete the rituals to avoid disagreement and out of caution for one's religion.
If the intercourse occurred due to ignorance that she had not completed the second stage of exiting ihram (tahallul ath-thani), then there is no penalty on her. However, if she knew that she was required to return to Makkah, then she must offer a dam (sacrifice of a sheep or goat) to be slaughtered in Makkah.
