Is a wife committing a sin by requesting divorce due to harm?
If the husband withholds maintenance or does not provide a separate dwelling, the wife has the right to seek divorce, especially if she is harmed by remaining in the marriage, and there is no sin upon her in that, for Allah Almighty says: "But if you fear that they will not uphold the limits of Allah, then there is no sin upon either of them concerning what she gives up to be freed thereby." And if the wife dislikes her husband for a legitimate reason and fears that she will not be able to fulfill Allah's right in obeying him, she is permitted to seek khul' (divorce at her initiation) in exchange for compensation. The husband has no right to his wife's money except with her willing consent, and he is not permitted to prevent her from her agreed-upon work without a legitimate reason.
