What is the ruling on helping my brother and his wife repay a usurious loan, whether by paying them a monthly sum or by settling the bank's debt in a single payment, while gifting a portion of it and requesting the remainder as a loan?
If a person is compelled to pay off usurious debts that exceed the principal amount, it is permissible to pay them. Accordingly, it is better to pay off the remaining bank debt in a single installment to extricate your brother from dealing with usury, whether the amount is the principal or the interest, as long as he has repented from dealing with usury. However, if his repentance is not evident, it is not advisable to pay any of the interest.
