Is it permissible for a girl to marry without a guardian through a judge after her family has rejected her, knowing that she is not a virgin and that the suitor's intention is to cover her and repent with her?
If a woman wishes to marry a man who is her equal (kuf'), and her guardian prevents her, she has the right to refer her case to the Sharia judge, who may either marry her himself or order her guardian to do so. However, she is not permitted to marry herself. It is incumbent upon anyone who has committed a sin and repented to conceal their own transgression, based on the Prophet Muhammad's (peace be upon him) saying: "O people, it is time for you to cease violating the limits of Allah. Whoever commits any of these abominations should conceal himself with the concealment of Allah, for whoever exposes himself to us, we will apply the Book of Allah upon him."
