Is it permissible to give charity (ṣadaqah) and zakat to a brother who does not observe prayer and fasting and who curses religion, when he is not in need of money?

Zakat is only to be given to its eight categories of recipients and not to the wealthy or to a disbeliever. One who reviles the religion is an apostate disbeliever, so zakat should not be given to him, even if he is poor. As for voluntary charity (sadaqat al-tatawwu’), some jurists have permitted giving it to an apostate, while others have prohibited it. The one who reviles the religion must be advised, and if he persists, his case should be referred to the Shariah court.
