A waqf (endowment) has two scenarios: The first is that it is executed during one's lifetime, in which case it is permissible, provided that it does not cause those for whom one is responsible to be left without support. The second is that the waqf is contingent upon death, in which case it is not permissible for it to exceed one-third [of the estate], because it falls under the ruling of a bequest, as the Prophet, peace and blessings be upon him, said to Sa'd: "A third, and a third is much." Accordingly, a person is not permitted to endow his only house if the waqf is contingent upon death, and it will only be executed within the limit of one-third unless the adult, sound-minded heirs consent.
