What is the ruling on my current work as a waiter in a restaurant where there is mixing of sexes, immodest display, and extravagance, and what is the ruling on embezzling money from the extravagant, and what is the ruling on stealing from the employer to reclaim my right that was unjustly withheld?

The ruling on working and earning wages in this place refers to fatwas no. 89689 and 121079.

It is not permissible to take money unjustly, even if its owners spend it on unlawful things. Repentance is obligatory, and the taken money must be returned to its owners, or, if reaching them is impossible, it should be given as charity on their behalf.

As for deductions from salary, their ruling refers to the contract terms, in accordance with the Almighty's saying: "O you who have believed, fulfill [your] contracts," and the Prophet's (peace be upon him) saying: "Muslims are bound by their conditions." If the deduction is clear injustice, then it is permissible to take from the employer's money an amount equivalent to the injustice, based on the issue of al-Zafar (taking one's right by force), as detailed in fatwa no. 45630.
