What is the ruling on an act over which scholars differ, if the doer does not intend disbelief but rather intends something else?

Whoever commits an act whose nature as disbelief is disputed, while being aware of its prohibition, is considered a disbeliever by those who deem it an act of disbelief, and not a disbeliever by those who consider it merely a sin, such as abandoning prayer. As for the layman, he must follow whoever he trusts among the scholars regarding matters of dispute, and the ruling of a judge resolves the dispute. However, Allah's judgment in matters subject to ijtihad (definition) (independent reasoning) will not be known until the Day of Judgment.
