It is permissible for a father to divide his wealth among his children before or after marrying a second wife, provided that this does not lead to the loss of a necessary expenditure due upon him, and provided that he is just among them. Scholars have differed on how to achieve justice between males and females in giving gifts. Some have said that equality means giving the male the same as the female, while others have said that it means giving the male the share of two females, by analogy with inheritance. The authorized opinion is equality, based on the hadith: "Be equitable among your children in giving gifts. If I were to prefer anyone, I would have preferred women," and based on the saying of the Prophet, peace and blessings be upon him: "Be just among your children."
