The question

To what extent is there negligence in the death of a patient whose condition was initially diagnosed as colic, then he returned with symptoms of internal bleeding and died? What is the ruling of Islamic law on this, is blood money (Diyya) obligatory, and what should the physician do if the family of the deceased is unknown?

The answer

If a skilled physician makes an error in prescribing medication to a patient, and this error causes the damage of an organ or the patient's death, then the physician is liable for it, even if they are not sinful. The liability entails the payment of blood money (Diyya) by the physician's 'Aqila (male agnates responsible for paying blood money). However, if the death is due to a delay in diagnosing and treating the illness, and this delay was due to a commonly recognized reason, or a lack of resources, or a large number of patients, then there is no sin or liability on the physician if they exerted their utmost effort.
