The wife's guardian does not have the right to order her to seek a divorce without a valid reason, and she is not permitted to obey him; for obedience is only in what is right and lawful. Divorce is in the hands of the husband; the guardian does not have the authority to effect it, nor does the Sharia judge have the authority to separate the spouses except for a valid reason, such as the husband's refusal to provide maintenance or his harming of the wife. A divorce decreed by a judge according to man-made laws does not take effect. The husband has the right to refuse to divorce his wife, and he may agree to divorce her with compensation or without.
