Does divorce take effect with the statement: "If you tell your family what happened between us, then consider yourself divorced," if the intention behind it was to threaten and prevent, and not with the intention of divorce, and then the wife proceeded to inform her family?

The phrase "Consider yourself divorced" is regarded by some scholars as an explicit divorce (talaq (definition) sareeh), while many contemporary scholars consider it a metaphorical expression of divorce (kinayat al-talaq). According to the latter view, which is the basis of the fatwa (definition), divorce does not occur by this phrase unless there is an intention (niyyah (definition)) to divorce. So, if the husband did not intend divorce but rather intended to threaten, then divorce does not take place.
