Is a wife considered sinful if she requests divorce from her husband who is not responsible, does not pray, curses and swears, and tells the children bad things about her, especially after she has borne the expenses for him, the home, and the children for years?

If a woman requests a divorce because her husband curses Allah and does not pray, she bears no sin, for cursing Allah and abandoning prayer are two characteristics that expel one from the Muslim community. Indeed, whoever curses Allah is an apostate by consensus, and likewise, whoever abandons prayer while denying its obligation is an apostate by consensus. Even if he acknowledges its obligation but deliberately abandons it, many scholars have held him to be an apostate, based on the Prophet's (peace be upon him) saying: "Indeed, between a man and polytheism and disbelief is the abandonment of prayer." Consequently, the woman becomes irrevocably separated from such a man if these actions are proven and he does not repent from them.
