The answer

Usurping land is unlawful, even if the usurpation is for the purpose of building a mosque upon it. This is due to the Prophet's (peace and blessings be upon him) saying: "Whoever usurps a span of land unjustly, Allah will encircle him with it from seven earths." Jurists have stipulated that a mosque must not be built on usurped land, and they have prohibited prayer in it if it is built on usurped land.
